Charges Withdrawn After Altercation in Northumberland Forest

Two people including the owner of a security firm who were charged after a altercation in Northumberland Forest have had their charges withdrawn in Cobourg Court after both agreed to a peace bond.

David Hutnyk (age 42) of Port Hope was charged with dangerous operation of a motor vehicle and Larry Francis (age 52) of Cobourg was charged with dangerous operation of a motor vehicle and two charges of assault stemming from an incident on a atv trail in Northumberland Forest on Saturday, June 5, 2021. The original release stated the altercation involved a Honda side-by-side off road vehicle as well as a pick-up truck that resulted in a collision.

Francis appeared by way of virtual court on February 1, 2022. Hutnyk appeared on Wednesday, March 16, 2022.

The Crown stated while on the atv trail Francis came “very close” to two security officers who were on the trail.

Francis did “donuts causing spinning rocks from the ground” and the security guards to take cover from the flying rocks.

The two security guards contacted the owner of the K9 Security David Hutnyk and said they had been assaulted by Francis who was operating a atv.

Hutnyk’s company was hired by Northumberland County to patrol the atv trails.

Court heard that Hutnyk had his wife and you child in his work vehicle as he began to look for Francis.

The two came into contact with each other near Pogue Road, when Hutnyk took a photo of Francis’ atv to confirm it was the same one in the previous altercation.

There was an “incident that resulted in the breach of the peace between the parties – a verbal altercation ensued.”

Both men entered into a peace bond for 12-months, stay away from each other and have a no-deposit monetary pledge of $500.
