Cobourg Police – Impaired Operation/Assaulting a Peace Officer

On Wednesday the 13th day of March 2019 at 2234 hrs police received a call for a fail to remain motor vehicle collision in the area of Elgin St West near Frei Street in the Town of Cobourg. A vehicle had lost control and struck a light standard. A short time later the suspect vehicle was seen travelling Westbound on Frei Street and stopped by police.

Police determined that the lone female driver was intoxicated by alcohol. Subsequently, Jessica Forsyth-Whelpdale, 25 years of age of Peterborough was arrested for Operation of a Motor Vehicle while her ability was impaired by alcohol. The accused was transported to the Cobourg Police Service where she refused to provide 2 suitable samples of her breath into an improved instrument. During the process the accused spat into the face of one the assisting officers.

As a result of the police investigation Jessica Forsyth-Whelpdale was charged with the following charges:

1. Impaired Operation of Motor Vehicle – alcohol or drugs contrary to Section 320.14(1)(a) of the Criminal Code
2. Failure or Refusal to Comply with Demand contrary to section 320.15(1) of the Criminal Code of Canada
3. Assault police contrary to section 270(1)(a) of the Criminal Code of Canada
4. Breach probation contrary to section 733.1(1) of the Criminal Code of Canada
5. Careless driving contrary to section 130(1) of the Highway Traffic Act of Ontario
6. Fail to report accident, contrary to section 199(1) of the Highway Traffic Act of Ontario
7. Fail to remain, contrary to section 200(1)(a) of the Highway Traffic Act of Ontario
8. Class G1 licence holder – unaccompanied by qualified driver contrary to Ontario regulation 340/94, section 5(1) of the Highway Traffic Act of Ontario
9. Driving motor vehicle with open container of liquor contrary to section 32(1) of the Liquor Licence Act of Ontario

The accused was held for a show cause hearing.
