Video – Cobourg Mayor Seeks Peace Bond

A Cobourg man appeared before a Justice of the Peace on Wednesday, June 26, 2024 after being served a Peace Bond by the Cobourg Mayor.

The case had previously been before a Justice of the Peace, but the summons had not been served on the individual, Robert Horgan.

On Wednesday afternoon, Cleveland and Horgan appeared before Justice of the Peace Joni Glover.
During the brief period the case was before the court, Cleveland gave a copy of his disclosure to Horgan and the Crown.

Justice Glover asked Horgan how much time he would like to look review the disclosure given by Cleveland.

“I’m unable to fully answer that question. I have requested information from Town records through the Information Officer.”

Horgan said due to the Information Officer no longer at the office, another person has taken over the request.

“I have all the documentation of my request. The Town hasn’t provided that disclosure to me. In addition

I requested that information from the Police Chief.”

Police stated they needed more time, and Horgan advised, “there are court proceedings that are relying on this information and the Ontario Human Rights Tribunal is requiring this information, but I”m at the mercy of the Town legislative clerk allowing me Town records as well as police records.”

Police have stated to Horgan it would take 90-days, “but perhaps the Police Chief could expedite that knowing that this matter is relying on it and release whatever information they do have available.”

Justice Glover asked Cleveland about putting the matter over for four weeks, which Cleveland was opposed too.

“The issue is Mr. Horgan is trying to bring in a counter-argument that somehow his personal rights are being violated. It isn’t actually addressing anything to do with the case. What he’s referring to is he wants to take me to the Human Rights Tribunal and that is part of the problem here. Mr. Horgan has been trespassed from town property because of his behavior. So the issue here is that I am uncomfortable waiting for four weeks because Mr. Horgan has shown that he is unable to prevent himself from recording, following, stalking and/or commenting on myself and/or my family and friends. So waiting for four weeks for Mr. Horgan to get records from a police check based on a accusation he wants to make against myself has no bearing or relevance on the case.”

Justice Glover explained to Cleveland that Horgan does have a right to get legal advice and look over the disclosure.

Horgan stated to the court, “at no time have I been following the Mayor outside of his role as Mayor. Yes, there was one occasion where he and son were violating by-law by operating a recreation motor-vehicle in an area where my neighbour, who is blind and relies on a cane to walk from Kelly’s (Kelly’s Homelike Inn) to the apartment. (Near King and George Street). It’s unsafe for anybody.”

Justice Glover said if Horgan does not consent to the order, it will be put over for a Hearing date.

The matter over to 2 p.m. on July 24, 2024.
