On the evening of Thursday, May 20, 2021, police responded to public complaints of suspicious traffic going in
and out of a residence in Cobourg. As a result of the complaints, police attended the area and conducted a
traffic stop on a vehicle.
As a result of police investigation, the driver, Mark KROENING, a 25-year-old man from Peterborough and the
passenger Seth GRAY, a 32-year-old man from the Town of Roseneath, were charged with numerous offences.
KROENING was charged with the following offences:
Operation while impaired – Alcohol contrary to section 320.14(1)(a) of the Criminal Code of Canada
Operation while impaired – Concentration of blood alcohol (over 80mg) contrary to section
320.14(1)(b) Criminal Code of Canada
Operation while prohibited contrary to section 320.18(1)(a) of the Criminal Code of Canada
Possession of ammunition contrary to Prohibition Order contrary to section 117.01(1) of the Criminal
Code of Canada
Use plates not authorized for vehicle contrary to Section 12(1)(d) of the Highway Traffic Act
Driving while under suspension contrary to Section 53(1) of the Highway Traffic Act
Drive motor vehicle no validation on place contrary to section 7(1)(c)(i) of the Highway Traffic Act
Driver – Fail to properly wear seatbelt contrary to section 106(2) of the Highway Traffic Act
Operate Motor Vehicle No Insurance contrary to section 2(1)(a) of the Compulsory Automobile
Insurance Act
Driving Motor Vehicle with Open Container of Liquor contrary to section 32(1) of the Liquor License
Act
Fail to Comply with an Order Made During a Declared Emergency contrary to section 7.0.11(1) of the
Emergency Management and Civil Protection Act
GRAY was charged with the following offences:
Fail to Comply with Probation contrary to section 733.1(1) of the Criminal Code of Canada x2
Possession of Ammunition Contrary to Prohibition Order contrary to section 117.01(1) of the Criminal
Code of Canada
Possession of a Schedule I Substance to wit Fentanyl contrary to section 4(1) of the Controlled Drugs
and Substances Act
Passenger – Fail to Properly Wear Seatbelt contrary to section 106(3)(b) of the Highway Traffic Act
Fail to Comply with an Order Made During a Declared Emergency contrary to section 7.0.11(1) of the
Emergency Management and Civil Protection Act
Both were released on undertakings and summonses with a future court date.
