Port Hope – Notice of Complete Application and Public Meeting Concerning a Proposed Zoning By-Law Amendment

TAKE NOTICE that the Council of the Corporation of the Municipality of Port Hope hereby considers an application to amend Zoning By-law 20/2010, as amended, under Section 34 of the Planning Act,submitted by D.G. Biddle & Associates Ltd. on behalf of the owner Ally Advice and Investments Ltd. (David McAulay) for lands municipally known 50 Hope Street North, to be a Complete Application in accordance with Section 34 (10.7) of the Planning Act. Furthermore, the Council of the Corporation of the Municipality of Port Hope will hold a Public Meeting on Wednesday, February 6th, 2019 at 6:30 p.m. at the Town Hall, 56 Queen Street, to consider the proposed application.

The subject lands are a corner lot, located north of Young Street on the west side of Hope Street North in the Urban Area of the Municipality of Port Hope (see Figure 1: Subject Lands Map). The lands are currently designated “Low Density Urban Residential” by the Municipality of Port Hope Official Plan and zoned Low Density Residential One, Type 2 ‘RES1-2’ Zone by Zoning By-Law 20/2010, as amended.

The rezoning is being requested to satisfy a condition of provisional Consent with respect to File B04/18. The purpose of the consent application was to sever approximately 324.8 square metres from the existing 661.4 square metres lot municipally known as 50 Hope Street North, to create one new residential building lot. A single detached dwelling is currently located on the proposed retained land. The owner proposes to demolish the existing dwelling and construct a new single detached dwelling with an attached garage on each of the proposed lots.

The purpose of the Zoning By-law Amendment is to rezone the proposed retained “Lot 1” from Low Density Residential One, Type 2 ‘RES1-2’ Zone to Low Density Residential Two, Type 2 ‘RES2-2’ Zone in order to permit a reduced lot area and lot frontage, and the proposed severed “Lot 2” (corner lot) from Low Density Residential One, Type 2 ‘RES1-2’ Zone to Low Density Residential Two, Type 2 Exception No. 122 ‘RES2-2(122)’ Zone in order to permit a reduced lot area, lot frontage and front yard setback (see Figure 2: Zoning By-law Amendment Sketch).

ANY PERSON may attend the Public Meeting and/or make written or verbal representation either in support of, or in opposition to the proposed Zoning By-law amendment. Should you be unable to attend the Public Meeting, your written submission will be received at the address given below up until the time of the Public Meeting.

If you wish to be notified of the decision of the Municipality of Port Hope on the proposed Zoning By-law Amendment, you must make a written request to the Municipality of Port Hope at the address of 56 Queen Street, Port Hope, ON L1A 3Z9.

If a person or public body would otherwise have an ability to appeal the decision of the Municipality of Port Hope to the Local Planning Appeal Tribunal but the person or public body does not make oral submissions at the public meeting or make written submissions to the Municipality of Port Hope before the by-law is passed, the person or public body is not entitled to appeal the decision.

If a person or public body does not make oral submissions at the public meeting, or make written submissions to the Municipality of Port Hope before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Local Planning Appeal Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.

Additional information and material about the proposed Zoning By-law Amendment (File: ZB08-2018) will be available to the public for inspection between 8:30 a.m. and 4:30 p.m., Monday to Friday, at the Municipal Development Team Office at 5 Mill Street South, Port Hope.
