Cobourg Police Service – Domestic Assault and Fail To Comply Charges

On Monday, July 20th, at 12:08 pm, police were dispatched to an address in the northeast end of the Town of Cobourg for a domestic assault. Police attended the address and spoke with the complainant, who advised police that their ex-partner had assaulted and sexually assaulted them.

The complainant advised police that the accused left the residence and was currently in possession of a knife.

Police arrested the accused after a brief foot pursuit a short distance from the scene, with the assistance of the Criminal Investigative Branch and the Bail Compliance Unit, near the intersection of Elgin Street West and Division.

Police located a prohibited knife, break and enter tools and stolen property. As a result of the investigation, the accused was charged with the following offences:

1. Assault – Spousal – Contrary to Section 266 of the Criminal Code ofCanada

2. Sexual Assault – Contrary to Section 271 of the Criminal Code of Canada

3. Utter Threats – Contrary to Section to 264.1(1)(a) of the Criminal Code of Canada

4. Harassing Communication – Contrary to Section 372(3) of the Criminal Code ofCanada

5. Breach of Undertaking – Contrary to Section 145(4)(a) of the Criminal Code of Canada

6. Breach of Release Order – Contrary to Section 145(5)(a) of the Criminal Code ofCanada x2

7. Fail to Comply with Probation – Contrary to Section 733.1(1) of the Criminal Code ofCanada x6

8. Carry Concealed Weapon – Contrary to Section 88 of the Criminal Code of Canada

9. Possession of a Prohibited Weapon – Contrary to Section 92(2) of the Criminal Code ofCanada

10. Possession of Prohibited Weapon Contrary to Prohibition Order – Contrary to Section 117.01(1) of the Criminal Code of Canada

11. Possession of Break in Instruments – Contrary to Section 351(1) of the Criminal Code of Canada

12. Possession of Property Obtained by Crime Under $5000 – Contrary to Section 355(b) of the Criminal Code of Canada

13. Theft – Contrary to Section 322(1) of the Criminal Code of Canada

The accused was held for a bail hearing with the Ontario Court of Justice via video conference. The name of the accused is being withheld to protect the identity of the complainant.

Sexual assault includes any non-consensual contact of a sexual nature. The Cobourg Police Service encourages victims to report incidents of sexual assault, including historical offences. There is no statute of limitations for sexual offences, and offenders can be prosecuted well after the date of the offence.
