Town of Cobourg Gives Notice of Inspection to Major Street Home

Municipal agencies from the Town of Cobourg were at 372 Major Street on Monday, July 31, 2023 for a inspection.

The inspection of the facility by By-Law officers gave a Notice of Violation along with a order to clean the yard and perform lawn maintenance.

The Notice of Violation dealt with the dwelling being used as a boarding house which is not permitted in  the Town of Cobourg’s Zoning By-Law.

The second dealt with the Clean Yard and Lot Maintenance.

A notice was given to remove all refuse in the driveway, including all garbage, mattresses, box springs, furniture and clothing.

Both notices were taped to the front door of the residence.

The residence on Major Street was were a suspect was stabbed recently

 

 

RE: NOTICE OF VIOLATION, Property located at 372 MAJOR STREET, COBOURG, ON,

Attention Property Owner:

The Town of Cobourg Municipal Law Enforcement and Licensing Services has conducted an inspection of your property and it has been determined the dwelling is being used as a Boarding House. A Boarding House is not a permitted use pursuant to the Town of Cobourg’s Zoning By-Law
85-2003. Your property is zoned R2 which permits the following uses;

Permitted Uses

i) group home use in accordance with the provisions of Section 5.23;

ii) public use in accordance with the provisions of Section 5.3.2;

ill) residential use.

Permitted Accessory Uses

i) accessory use to the Permitted Uses under Section 8.1.1:

ii) day nursery use;

iii) home occupation use;

iv) one bed and breakfast establishment.

A Boarding Housed is not a permitted use in a Residential (R2) Zone. Accordingly, you are required to cease the unlawful use of this property immediately.

Failure to comply with this notice of violation may result in a charge being laid under the Ontario Planning Act R.S.O 1990, if compliance is not achieved and the unlawful use continues. You are further advised that every person who contravenes the Act and, if the person is a corporation, every director or officer of the corporation who knowingly concurs in the contravention, is guilty of an offence and on conviction is liable, on a first conviction to a fine of not more than $25,000 and where a corporation is convicted on a first conviction a fine of not more than $50,000.

The property located at the above noted address has been determined to be in non-compliance with the following:

Town of Cobourg Clean Yard and Lot Maintenance By-Law 060-2017 as amended, Section 2.1

2.1 No Owner or Occupant shall permit on a lot; (b) waste;

Required Action: Remove all refuse in the driveway, including all garbage, mattresses, box springs, furniture and clothing.

Compliance Required By: Compliance with the terms and conditions of this order must be made on or before August 4, 2023, at 1:00 PM.
