Cobourg Police – Man Tasered After Failing To Leave Premises for Not Wearing Mask

On Wednesday, December 16, police were dispatched to a business in the north west area of the Town of Cobourg for an unwanted person. It was reported that staff were having an on-going issue with a man not wearing a mask and wanted him removed from the business.

Police asked the man to leave the premises, and he declined. The accused was arrested for failing to leave the premise upon direction.

The accused resisted arrested, and police deployed a conducted energy weapon (also known as a Taser) in order to safely effect the arrest.

As a result, Brett SMITH, a 54 year-old-man from Cobourg, was charged with the following offences:

1. Fail to Leave Premises Upon Direction – Contrary to Section 2(1)(b)1(2) of the Trespass to Property Act

2. Cause Disturbance – Contrary to Section 175(1)(a) of the Criminal Code of Canada

3. Assault with Intent to Resist Arrest – Contrary to Section 270(1)(b) of the Criminal Code of Canada

The accused was released on an undertaking and summons with a future court date.
